A. Information You Provide to Us (Data Controller)

- Authentication Data: OAuth tokens, API keys, and integration credentials required to connect your third-party accounts (e.g., Shopify, Meta, Slack) to our platforms.
- Communication Data: Records of your correspondence with our support or sales teams.
B. Information Processed on Your Behalf (Data Processor)
When you use our hosted applications (such as Trinacle Chat) to interact with your end-users, we process data on your behalf. This may include:
- End-User Chat Transcripts: Messages, files, and media sent between your agents and your customers via website widgets, Facebook Messenger, Instagram Direct Messages, or other connected channels.
- E-Commerce Data: Customer purchase history, order status, cart contents, and lifetime value fetched dynamically from platforms like Shopify to provide context to your support agents.
- Device and Usage Data: IP addresses, browser types, and general location data of end-users interacting with the chat widgets on your digital properties.
2. How We Use the Information
We use the collected information for the following purposes:
- To provide, maintain, and improve our marketing services and software applications.
- To facilitate third-party integrations (e.g., synchronizing Shopify order data with Trinacle Chat to enhance customer support workflows).
- To process transactions and send related information, including confirmations and invoices.
- To respond to customer service requests and provide technical support.
- To monitor application performance, detect security incidents, and protect against fraudulent or illegal activity.
Special Notice Regarding Meta (Facebook/Instagram) API Data
Trinacle Chat connects to the Meta Graph API to route messages from Facebook Pages and Instagram Business accounts. We strictly adhere to the Meta Platform Terms and Developer Policies. Data received via Meta webhooks (such as incoming messages and user profile names) is used exclusively to display the conversation within your agent dashboard so you can reply to your customers. We do not use Meta API data for targeted advertising, we do not sell this data, and we do not share it with unauthorized third-party brokers.
3. Data Sharing and Disclosure
We do not sell, rent, or trade your personal information. We may share information only in the following circumstances:
- Service Providers: We may share data with trusted third-party vendors who provide cloud hosting, database management, and payment processing, strictly under confidentiality agreements.
- Legal Compliance: We may disclose information if required to do so by law, subpoena, or in response to lawful requests by public authorities.
- Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, user data may be transferred to the acquiring entity.
4. Data Retention and Deletion

Data Deletion Request Instructions
If you wish to remove an integration (such as an Instagram inbox or Shopify store) or delete your Trinacle account entirely:
- App Disconnection: You may disconnect Meta, Shopify, or other apps directly from the "Settings > Integrations" or "Inboxes" tab within your dashboard. Disconnecting an inbox immediately stops all webhook data flows from that platform.
- Account & Data Deletion: You may request full deletion of your account, including all historical chat logs, customer data, and API tokens, by contacting our support team at legal@trinacle.com. We will process all deletion requests within 30 days.
5. Security of Your Information
We implement industry-standard security measures to protect your data, including encrypted data transmission (HTTPS/TLS) and restricted access controls. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

2. Account Registration and Responsibilities
To use our software applications, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security and confidentiality of your login credentials.

- Upload or distribute viruses, malware, or any other malicious computer code.

- Use the platforms to collect or store highly sensitive personal information (e.g., full credit card numbers, Social Security numbers, or protected health information) outside of designated secure payment gateways.
4. Third-Party Integrations
Our applications allow you to connect with third-party platforms (e.g., Meta, Shopify). Your use of these third-party integrations is governed solely by the terms of service and privacy policies of those respective platforms. Trinacle is not responsible for the performance, availability, or data practices of these third-party services. If a third-party platform changes its API rules or restricts our access, we may suspend that specific integration without liability to you.
5. Intellectual Property
All content, branding, logos, software code, and designs provided by Trinacle (excluding your specific client data and third-party trademarks) are the exclusive property of Trinacle and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services strictly for your internal business operations.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Trinacle and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of the Services.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Puerto Rico and applicable federal laws of the United States, without regard to its conflict of law provisions.
